The Trademark Registration Request through the Madrid System has the following benefits in comparison to the Trademark Registration Request individually country by country:
- One Trademark Registration Request: Only one application with the same description, language and currency is required to be able to request your trademark in various countries; when filing individually in each country, you must submit each application separately.
- Power of Attorney Requirements: You must only comply with the power of attorney requirements of the base country; when filing individually in each country, you must comply with the power of attorney requirements in each country (which may be costly and time consuming).
- Fees: When considering various countries (more than 5), the fees might be lower if done through the Madrid System.
Some factors to take into consideration regarding the Madrid System include:
- Only natural/legal persons with nationality, domicile, or a commercial establishment in the base country can file applications under this system.
- The international trademark remains dependent of the base country trademark for 5 years since the international filing date; if, during the first 5 years, the base country trademark is rejected, removed, cancelled or limited, the international trademark will be cancelled.
