What are the advantages and disadvantages of the Madrid System?

The Trademark Registration Request through the Madrid System has the following benefits in comparison to the Trademark Registration Request individually country by country:

  • One Trademark Registration Request: Only one application with the same description, language and currency is required to be able to request your trademark in various countries; when filing individually in each country, you must submit each application separately.
  • Power of Attorney Requirements: You must only comply with the power of attorney requirements of the base country; when filing individually in each country, you must comply with the power of attorney requirements in each country (which may be costly and time consuming).
  • Fees: When considering various countries (more than 5), the fees might be lower if done through the Madrid System.

Some factors to take into consideration regarding the Madrid System include:

  • Only natural/legal persons with nationality, domicile, or a commercial establishment in the base country can file applications under this system.
  • The international trademark remains dependent of the base country trademark for 5 years since the international filing date; if, during the first 5 years, the base country trademark is rejected, removed, cancelled or limited, the international trademark will be cancelled.
